The everxcloud.ai website, the Portal, the EverXCloud application programming interface and the related Services are operated by EverXCloud Inc., a Delaware corporation ("EverXCloud"), which is the only entity that operates the platform and sells the Services in its own name.

4. Hosting

The website, the Portal and the application programming interface are hosted on a dedicated server located in the United States, leased from a third-party hosting provider and operated by EverXCloud.

Content delivery, DNS and network security services are provided by Cloudflare, Inc., 101 Townsend Street, San Francisco, California 94107, United States.

Instances rented through the Services run on hardware operated by EverXCloud or by third-party Providers, in the locations indicated in the Portal.

5. Intellectual property and trademarks

The website, the Portal and their content, including text, graphics, logos, icons, software, page layouts and documentation, are owned by EverXCloud or its licensors and are protected by copyright, trademark and other intellectual property laws. EverXCloud, everxcloud.ai and the EverXCloud logos are trademarks of EverXCloud. Other names, trademarks and logos, including the names of hardware manufacturers and models, belong to their respective owners and are used for identification purposes only; their use does not imply any affiliation with or endorsement by those owners.

Except as expressly permitted by the Terms of Service or by applicable law, you may not copy, reproduce, modify, distribute, publicly display or create derivative works from any part of the website or the Portal, or use our trademarks, without our prior written permission. You may link to the home page of the website provided that the link does not suggest an affiliation with or endorsement by EverXCloud that does not exist.

6. Information on the website

The information on the website is provided for general information purposes. Prices, availability, specifications and performance figures may change at any time and are binding only as stated in the Portal at the time of an Order and under the Terms of Service.

Nothing on the website or in the support materials constitutes legal, tax, financial, investment or other professional advice. The market and exchange features of the Services relate to the purchase of computing time and do not constitute a financial product or investment service.

7. Links to third-party websites

The website and the Portal may contain links to websites, documentation or services operated by third parties. We do not control and are not responsible for their content, availability or privacy practices. Access to them is at your own risk and subject to their own terms.

8. Reporting abuse and copyright infringement

To report a suspected abuse of the Services, such as malware, phishing, spam, attacks originating from our network, unlawful content or a violation of export control or sanctions laws, or to submit a notice of alleged copyright infringement, follow the procedure set out in the Acceptable Use Policy, available at everxcloud.ai/legal/aup, or write to [email protected] with "Abuse report" or "Copyright notice" in the subject line.

9. Governing documents

Use of the Services is governed by the Terms of Service and by the policies they incorporate: the Acceptable Use Policy, the Refund and Cancellation Policy, the Service Level Agreement, the Tax Policy and Invoicing and, for Business Customers, the Data Processing Addendum. The processing of personal data is described in the Privacy Policy and the Cookie Policy, and the supply of capacity by Providers is governed by the Supplier Agreement. These documents are available at everxcloud.ai/legal. The English version of these documents prevails over any translation.

This Legal Notice is governed by the laws of the State of Delaware, United States, without prejudice to the mandatory rights of consumers under the law of their country of residence.
